As the Government stated earlier this year, nutrient pollution is an urgent problem for our freshwater habitats, streams and rivers which needs rectifying. Tackling this is imperative to stop the decline in biodiversity in these environments, but also it is crucial to tackle this to meet the countries legal commitments.
So whilst we all recognise this is an important topic, it has felt hard by the development sector which has felt it is had born the unfair burden of the effects of nitrate pollution in sensitive areas. If a development is to obtain approval, then it needs to overcome the barriers which prevent development if nitrate neutrality cannot be achieved. It is reported this alone has prevented 100,000 homes from being built, which again puts pressure on the housing market.
But is this the correct position? Has the development sector taken the brunt of this nitrate neutrality position? Can other sectors and the water companies do more?
In this seminar we will look at the present position and the proposals currently in the House of Lords in relation to LURB together with practical examples from both planning applications and property transactions on how these schemes are dealt with from a legal perspective. It will also cover the overlap with both water neutrality and biodiversity net gain, with a view to identifying opportunities for clients with larger property portfolios. We also have a private client solicitor providing an insight into how these schemes might effect a client’s inheritance tax position.
