Property Related Professional Negligence Claims

Nicola Muir and John de Waal will discuss topical issues in professional negligence claims against surveyors and solicitors and provide essential tips for practitioners, whether suing or being sued.
Nicola and John are both experienced property and professional negligence barristers from Hardwicke Chambers.
Nicola (herself a former solicitor who is very experienced in claims against surveyors) will speak on surveyor’s negligence dealing with matters such as failure to inspect, valuation issues (including over-valuation) and claims by lenders as well as the assessment of damages.
John (whose practice splits about 60/40 between property and property-related professional indemnity work) will speak on solicitor’s negligence with the provisional title ‘How to be sued, and how to lose the claim once you have been sued’, covering conveyancing claims, mitigation of loss and contributory negligence, and the relevant principles for determining causation and foreseeability.
